Many people like to buy live pets online for breeding. However, when receiving goods, the pets are lively and sucking, but they become sick or die within a few days of raising them. Not only does it cost to detect and treat, but it is also difficult to accept emotionally because the buyer and the pet have established emotions. Look, Mr. Chen has encountered such an upset recently.

Mr. Chen's wife Xiao Ke likes kittens very much, but she often travels on business trips due to work reasons. In order to keep her wife company, Mr. Chen specially bought British short cats online as a gift to his wife before the Double Eleven Shopping Festival. When the courier handed the kitten to Xiao Ke, he found that the kitten's appearance did not match the promotional photos of the merchant that Mr. Chen originally sent her. The kitten had gray-blue eyes and black nose on the promotional photos, and the merchant said it was a cub. But the kitten she received had yellow eyes, pink nose, and was not a cub. Seeing the little cat's pitiful appearance, Xiao Ke reluctantly accepted it. Unexpectedly, Xiao Ke and the kitten got along very well for three days, but on the fourth day, the kitten did not eat or drink and had diarrhea symptoms. Xiao Ke quickly sent the kitten to the nearby pet hospital for treatment. After an examination by the pet hospital, it was found that the kitten suffered from cat plague and would die if it was not treated in time. However, the treatment cost was very expensive. Xiao Ke hesitated and discussed with her husband. Mr. Chen asked him to treat the kitten first and contact the merchant for solutions. In this way, after paying more than 10,000 yuan in treatment fees, the kitten recovered and Mr. Chen began his own way of protecting his rights. He contacted him many times, and the merchant repeatedly stated that the kittens he sold were healthy and also passed various inspections during transportation, and Mr. Chen received the kitten's health certificate. Mr. Chen certainly disagrees with the merchant's statement. He said that when performing various examinations on the kitten at the pet hospital, the medical record of the pet hospital stated that the kitten itself (maternal infection) suffered from cat plague virus and was not a healthy kitten. Both parties had their own opinions, and Mr. Chen had no choice but to sue the merchant in court. Judge Lin Na of the Civil Court of Weiyang Court accepted the online shopping dispute. Because the defendant, the merchant is in Henan, Judge Lin Na finally contacted the merchant on the online shopping platform through the intensive delivery of electronic information in our court and delivered Mr. Chen’s complaint and response materials to the merchant. Given that the case was relatively simple, the judge organized the exchange of evidence through a simple and efficient micro-trial trial and directly informed the merchant that the health certificate he printed on himself did not undergo any authoritative animal testing report, nor did he mark the seal of the institution, so it could not prove that the kittens for sale were healthy, and obviously the evidence was insufficient. After hearing the judge's explanation, the merchant expressed his willingness to mediate out of court with Mr. Chen. Finally, the two parties reached an agreement, and the merchant agreed to compensate Mr. Chen 8,000 yuan in court, and Mr. Chen immediately submitted an application for withdrawal to the judge. The judge reminded that when purchasing pets, consumers are advised to meet and trade when conditions permit, and at the same time, they should confirm whether the pet store has a business license. When trading, you should carefully review your pet's vaccine injection records and health certificates. If you need to buy pets online, you should also choose a formal website with a third-party payment platform, and pay attention to the merchant’s relevant industrial and commercial registration information and specific business address. Before purchasing, you should confirm the situation of the pet being vaccinated, and ask the merchant to provide the injection certificate and keep it. At the same time, consumers should also ask the merchant to issue an invoice and sign an agreement with the merchant on pet vaccination, pet health testing, after-sales dispute resolution plans, etc., clarify the responsibilities of both parties and protect their legitimate rights and interests.
